Testamentary Gifts to Remsen St. Mary’s 

The language used in your will or revocable living trust, establishing your gift to St. Mary’s Schools and/or St. Mary’s Parish, is dependent upon your financial, personal, and spiritual goals and circumstances. 

The following sample provisions can be used individually or together.  We hope they will be advantageous to you and your professional advisor. 

The school is a mission of the parish and shares the same tax exempt number.  You will need to specify if you intend the gift to be for the school.

Sample Language You May Use

Unrestricted General Gift:

“I give to St. Mary’s Schools Endowment Fund of Remsen, Iowa, or  the Remsen St. Mary’s Parish of Remsen, Iowa, an amount equal to                  percent (___%) of my adjusted gross estate as finally determined for federal tax purposes.”  

Amount of Gift Dependent Upon the Size of the Estate

“I give to St. Mary’s Schools / St. Mary’s Schools Endowment Fund / Parish of St. Mary’s of Remsen, Iowa, an amount equal to                    percent (___ %) of my adjusted gross estate as finally determined for federal taxes purposes, or                                dollars ($                    ), whichever is larger.” 

Gift for a Specific Purpose

“I give to St. Mary’s Schools / St. Mary’s Schools Endowment Fund / Parish of St. Mary’s of Remsen, Iowa, an amount equal to                       percent (___ %) of my adjusted gross estate as finally determined for federal taxes purposes.  This amount shall be for the school/endowed fund and is to be administered under the terms of an agreement I have on file with the school/endowment fund.”  

“I give my collection of (description of personal property) to St. Mary’s Schools / St. Mary’s Schools Endowment Fund / Parish of St. Mary’s of Remsen, Iowa.” 

Gift of Residuary Estate

“I give the residue of property owned by me at the time of my death, real and personal and wherever situate to St. Mary’s Schools / St. Mary’s Schools Endowment Fund / Parish of St. Mary’s of Remsen, Iowa.” 

Contingent Gift of Residuary Estate

“I give the residue of the property owned by me at my death, real and personal and wherever situate, to my (heir)                                          if he/she survives me.  If he/she does not survive me, I give my residuary estate to St. Mary’s Schools / St. Mary’s Schools Endowment Fund / Parish of St. Mary’s of Remsen, Iowa."

Provision Allowing for Both Income Tax and Estate Tax Benefits

“I instruct that all of my charitable gifts, bequests, and devises shall be made to the extent possible, from property that constitutes “income in respect of a decedent” as that term is defined in the Internal Revenue Code.”

The St. Mary’s Schools, St. Mary’s Schools and Parish Endowment Funds and St. Mary’s Parish are tax-exempt organizations under Section 501©(3) of the Internal Revenue Code.  The proper name for any planned gift for St. Mary’s Schools or Parish is “St. Mary’s Roman Catholic Church Inc.,” in Remsen, Iowa, ID # 42-0698236. Under this legal name you may designate to St. Mary’s Schools, St. Mary’s School or Parish Endowment funds, or St. Mary’s Parish.
